These Terms of Use (“Terms”) govern your use of the Motive iOS application (“Motive” or the “App”) provided by DAM Studio (“we”, “us”, or “our”). By downloading or using Motive, you agree to these Terms. If you do not agree, do not use the App.

Licensed Application End User License Agreement: where required by Apple, the App is also subject to the standard Apple Licensed Application End User License Agreement available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms conflict with Apple’s standard EULA on a point Apple requires, Apple’s EULA controls for that point.

1. The App

Motive is a habit tracker and to-do tool. Completing tasks can earn unlock minutes that temporarily unblock apps you have limited with Apple Screen Time. Earned minutes expire at the end of each day and have no cash or monetary value.

Motive is a self-control aid only. We do not guarantee any particular outcome, productivity result, or behavioral change. Apple Screen Time and related APIs may behave differently depending on iOS version, device configuration, Screen Time settings, and Apple platform limitations. We are not responsible for those platform limitations.

2. Free and Pro features

Motive offers a free version with limits, including:

Up to 5 open tasks per day
Unlock duration limited to 15 minutes

Motive Pro unlocks additional features, which may include:

Unlimited tasks
Recurring tasks
Custom categories
Customizable rewards
Child mode
Unlock durations of 30 or 60 minutes

Feature availability may change as we improve the App. Material changes to paid features will be reflected in the App Store listing and/or in-app messaging where appropriate.

3. Subscriptions (Motive Pro)

Motive Pro is offered as an auto-renewable subscription through the Apple App Store. The monthly subscription product identifier is 4.month.motive. A free trial may be offered when available through Apple.

Payment will be charged to your Apple ID account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your Apple ID account settings after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription where applicable.

Prices are displayed in the App Store at the time of purchase and may vary by region. Apple’s terms apply to billing.

4. Refunds

Refunds for App Store purchases are handled by Apple. Request a refund at reportaproblem.apple.com. We cannot process App Store refunds directly.

5. Local data; no accounts

Motive does not provide user accounts. Your tasks, history, settings, and related data are stored locally on your device. You are responsible for backing up your device if you want to retain that data. We are not liable for loss of local data, including loss caused by deleting the App, using Delete all data, device failure, OS updates, or transfers between devices.

6. Acceptable use

You agree to use Motive only in accordance with applicable law and these Terms. You may not misuse Screen Time or related system features in ways that violate Apple’s terms or harm others’ devices or accounts that you do not control.

7. Intellectual property

Motive, including its design, text, graphics, and software, is owned by DAM Studio or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of any IP to you. You receive a limited, non-exclusive, non-transferable license to use the App on Apple devices you own or control, as permitted by the App Store Rules and Apple’s standard EULA.

8. Disclaimer of warranties

To the maximum extent permitted by law, Motive is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that Screen Time unlocking will always work as expected.

9. Limitation of liability

To the maximum extent permitted by law, DAM Studio and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of or inability to use Motive. Our total liability for any claim relating to the App will not exceed the amount you paid us for Motive Pro (if any) in the twelve (12) months before the claim, or zero if you only used the free version. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

10. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless DAM Studio from claims arising out of your misuse of the App or your violation of these Terms.

11. Privacy

Our collection and use of information is described in the Privacy Policy.

12. Changes

We may update these Terms by posting a new version on this page with a revised effective date. Continued use of the App after changes become effective constitutes acceptance, to the extent permitted by law. If you do not agree, stop using the App and cancel any subscription through Apple.

13. Governing law

These Terms are governed by the laws of the Kyrgyz Republic, without regard to conflict-of-law principles. Courts located in the Kyrgyz Republic shall have jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protections that apply in your country of residence and subject to Apple’s requirements where applicable.
